Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Moda (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Moda is a driving logbook application designed to help teen drivers and their supervisors track supervised driving hours required for state licensing. The App provides session logging, progress tracking, weather recording, and DMV-ready export functionality.

3. Eligibility

The App is intended for users who hold a valid learner's permit or are supervising a learner driver. Users under 18 must have parental or guardian consent to use the App. By using the App, you confirm that you meet these eligibility requirements.

4. Account and Data

You may use the App in local-only mode without creating an account. If you choose to sync data to our servers, you are responsible for maintaining the confidentiality of your account. You agree to provide accurate information and to update it as necessary.

5. Purchase and Payment

Moda offers a one-time in-app purchase at $4.99 to unlock all premium features.

• Payment is charged to your Apple ID account at confirmation of purchase.
• This is a one-time purchase — there is no subscription and no recurring charges.
• Your purchase unlocks premium features permanently on all devices signed in with the same Apple ID and is shared with your Family Sharing group.
• You can restore your purchase at any time via the App's settings.

Refunds are handled by Apple according to their refund policy.

6. Accuracy of Data

The App records driving session data based on user input and device sensors. While we strive for accuracy, Moda does not guarantee that recorded data will be accepted by any DMV or licensing authority. The App is a logging tool, not a legal document. Users are responsible for verifying the accuracy of their logs.

7. Weather Data

Weather information is provided by Apple WeatherKit. Weather data is approximate and may not perfectly reflect conditions at your exact location. Weather data should not be relied upon for safety decisions.

8. Location Data

The App records start and end locations of driving sessions to help verify session occurrence and classify road types. The App does not continuously track your location during a session. Location data collection requires your explicit permission and can be denied without losing core App functionality.

9. No Guarantee of Compliance

While Moda is designed to track state-specific driving requirements, the App does not guarantee legal compliance with any state's graduated driver licensing program. Laws change, and users should verify current requirements with their local DMV or licensing authority.

10. Safety Disclaimer

The App is not a substitute for proper driving instruction or supervision. Never interact with the App while driving. The supervising driver should start and stop sessions. The App should never distract from safe driving practices.

11. Intellectual Property

The App and all its content, features, and functionality are owned by Creayo LLC and are protected by copyright, trademark, and other intellectual property laws.

12. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

13. Limitation of Liability

To the maximum extent permitted by law, Creayo LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.
